Michael Thrall’s article “Attorneys’ Fees Under ERISA – Is Proportionality Dead?” was the featured article in
The Voice, the electronic publication of DRI - The Voice of the Defense Bar on September 23, 2009. The article examines recent case law holding that attorney fees can be awarded in excess of the amount of benefits in controversy and offers alternative arguments and strategies to the traditional proportionality arguments recently rejected by some courts.
