The U.S. Patent and Trademark Office (USPTO) recently granted Facebook a notice of allowance on its trademark application for "FACE". If it registers, while Facebook will not be able to prevent everyone else from using "FACE" for every possible purpose, the application does cover usages in "[t]elecommunication services, namely, providing online chat rooms and electronic bulletin boards for transmission of messages among computer users in the field of general interest and concerning social and entertainment subject matter, none primarily featuring or relating to motoring or to cars."
Now that the mark has been allowed, Facebook will still have to file a statement of use demonstrating use of the trademark in commerce before the application registers. However, it appears likely that soon others with social networking sites will have to think twice before using anything similar to "FACE" on their site.
